Sounds of Summer – SUMMER PROMOTION

TERMS & CONDITIONS

  1. This competition commences on 01 st October 2019 and ends at midnight on 31 st December 2019. (“Competition Period”). Entries received outside of this Competition Period will not be accepted.
  2. This competition “Sounds of Summer” is open to all citizens and legal residents of the Republic of South Africa (“Participants”), except the shareholders, directors, employees, partners, agents and consultants of The Beverage Company (“the Promoter”), or any other person who directly OR indirectly controls, or is controlled by, the Promoter, OR a supplier of goods or services in connection with this competition, their advertising agencies , and their respective employees, life partners, business partners and immediate families, (“Disqualified Persons”).
  3. For the Competition Period, Coo-ee® soft drinks with purple bottle caps (“Participating Products”) will be available to purchase from retail outlets in the Republic of South Africa which sell Coo-ee® soft drink brands.
  4. Each purple bottle-cap contains a unique code required to enter the competition. You may enter this competition as many times as you like, but each unique code may only be used once.
  5. To enter, you must during the Competition Period, purchase any two (2) Participating Products, dial *120*7734# and enter your unique codes found under the promotional purple bottle-cap. You are not required to enter both codes at the same time, however your entry will only be successful when both codes have been entered. By submitting an entry, you are deemed to agree to these competition rules. USSD line costs R0.20 per 60 seconds.
  6. With each entry, you stand a chance to win:
    1. Mobile Airtime from MTN, Vodacom, Cell C and Telkom Mobile
    2. Samsung A9 Smartphone
    3. The Grand Cash Prize of R250 000 (Two Hundred and Fifty Thousand Rand) – will be deposited into the valid, nominated South African bank account of the winner.
  7. Mobile airtime prizes of various values will be given away daily during the Competition Period. A total of R150 000 (One Hundred and Fifty Thousand Rand) worth of mobile airtime will be given away. On the day of the draw, the airtime won will be debited to the mobile number used by the winner to enter the competition.
  8. Should mobile airtime prizes be awarded to a mobile number that is unable to utilize the prize (i.e. the mobile number is not on a prepaid subscription), the prize will be withdrawn and re-entered into the prize pool for distribution to other Participants. These winners will still however be entered into the draw for the weekly and grand prizes.
  9. One Samsung A9 Smartphone will be given away each week. The winner will be drawn every Friday at 12pm during the Competition Period.
  10. The final draw for the Grand Cash Prize will take place on Friday, 10 th January 2020.
  11. Winners of all prizes will be the first correct entries selected by a random computer- generated draw which takes place at 23 Palmgate Crescent, Southgate Business Park, Durban and is audited by an independent third party. All winners will be notified by telephone call (except winners of mobile airtime, who may be notified by SMS). Should the winner not answer after 3 (three) telephone calls, the winner will forfeit their winnings and a redraw will take place to find a new winner.
  12. The Promoter will conduct a random draw from the total list of entrants to determine the possible Grand Cash Prize winner. The potential winner will be contacted by the Promoter via the mobile number used to enter the Competition and will be required to participate in an audit verification process and provide a copy of their Identity Document/Proof of Residency. Once the required audit verification has been completed, confirmed and verified,the possible winner will be declared as an official Grand Cash Prize winner and will be contacted by Promoter to complete, sign and return a prize acceptance form to facilitate the deposit of the Grand Cash Prize into the chosen South African Bank Account of the winner. If the potential Grand Cash Prize winner does not provide the Promoter with a copy of their Identity Document / Proof of Residency and/or the completed, signed prize acceptance form and/or sufficient proof of bank details within 2 (two) days of request by the Promoter to do so, the Promoter will keep trying for 48 (forty eight) hours before a replacement/ substitute Grand Cash Prize winner is drawn in the same manner as the first. The Grand Cash Prize will be paid into the Grand Cash Prize winner’s nominated South African bank account within 7 (seven) days after the audit verification process has been completed and the potential Grand Cash Prize winner has provided the Promoter with all required documents including but not limited to their Identity Document / Proof of Residency completed, signed prize acceptance form and sufficient proof of their nominated South African bank account.
  13. Promoter will not be responsible for any other expenses whatsoever which the winner may incur as a result of their acceptance and/or use of the Mobile Airtime and/or Weekly Prizes and/or Grand Cash Prize, whether foreseen or not.
  14. The names of the winners will be announced on www.cooee.co.za; as well as, on the Coo-ee Facebook page (Coo-ee® Soft drinks).
  15. Prizes will be couriered to the winners thereof from Monday to Friday, between the hours of 8am and 4pm. The Promotor or its agent will contact each winner to advise the winner of the approximate date and time of delivery of his prize. Each winner must provide the Promotor with a suitable physical address at which the winner is prepared to accept delivery of the prize.
  16. Delivery of the prize must be accepted within 30 (thirty) days from the date on which the winner is notified telephonically that he has won the prize.
  17. The winner must provide the Promotor and/or its agent with original proof of identification (ID) on delivery of the prize.
  18. If the winner fails to accept delivery of his prize within the period stipulated above, the winner will forfeit his prize.
  19. Participants can monitor the progress of the competition on www.cooee.co.za.
  20. Prizes are not transferable and cannot be exchanged for cash. Airtime can be transferred from a contract number to a pre-paid number through the winner’s service provider via SMS at the winner’s expense.
  21. Winners may be invited to take part in publicity but will be afforded the opportunity to decline such invitation. Winners will not be entitled to any payment or remuneration for any such publicity. Any and all publicity materials shall remain the sole property of the Promoter.
  22. The Promoter reserves the right to terminate, temporarily suspend or amend this competition in the event of any unforeseen circumstances outside its reasonable control or other technical or other difficulties that might compromise its integrity.
  23. Any participant who transgresses any of these terms and conditions or disparages the promotion or promotional brand/s in any way or who acts in any way contrary to the spirit of this Competition, may be banned from entry into this, or into any other of the Promoter’s promotional competitions. The Promoter reserves the right (subject to applicable law) to disqualify or ban any individual who tampers with or attempts to subvert or interfere with the Competition or entry process or prize retrieval process.
  24. The decisions of the Promoter are final and may not be challenged. No correspondence will be entertained.
  25. Declaring the winnings to SARS will be the responsibility of the prize winners.
  26. In cases where prize of money (cash) is paid into the incorrect bank account or such monies or part thereof are stolen, the Promoter will not replace or reimburse the remaining balance of the cash. The Promoter will not be responsible for any balance of cash lost as a result of theft or fraud. The Promoter will not be responsible for any unauthorised use of cash where the card number, PIN, bank account details or any authorising credentials have become known to another party.
  27. Should any claims arise from defects related to the Samsung A9 Smartphone prizes, winners must pursue such claims with the manufacturer thereof. For avoidance of doubt, the Promoter is not liable for any defect in the Prizes. All ancillary costs, including but not limited to transport, meals, personal and incidental expenses, insurance, government taxes or other fees applicable, are the responsibility of the winners, and/or entrants.
  28. The Promoter reserves the right to cancel or amend or alter the Competition and its rules or prizes (not already awarded, to any other substitute prize of comparable commercial value) at their own discretion at any time, if deemed necessary in their opinion and/or if circumstances arise outside of their control, without prior notice and no entrant shall have recourse for such cancellation or alteration. Any changes will be posted either within the competition information or these terms and conditions shall become effective immediately after being altered or on such date as may be determined by the Promoter. No participant shall have any recourse against the Promoter as a result of the alterations of the rules or prizes.
  29. All Participants and winners to the maximum extent permitted by law, indemnify the Promoter, its associated companies (directors, officers and employees), affiliates and agents, against any/all claims for any loss or damages, whether direct, indirect, consequential or otherwise, harm, injury of any nature whatsoever arising from any cause whatsoever from their participation in any way whatsoever in this Competition.
  30. All entrants and participants are advised that in compliance with the laws of the country, Promoter is required to retain certain information (where applicable) of participants, entrants and winners for a period of time (“Personal Information”). Such Personal Information to be retained by the Promoter includes (but is not limited to) the full names, identity numbers, contact details and winner’s acknowledgement of prize receipts. Accordingly, the Promoter will require the winners to provide written confirmation of permission to enable the Promoter to ensure compliance with these rules, as well as with the Protection of Personal Information Act (“POPI”) and South African Consumer Protection Act 68 of 2008 (“Consumer Act”). Should any entrant, participant and/or winner refuse or be unable to comply with this rule for any reason, such entrant, participant and/or winner will be deemed to have rejected the Prize(s) and it shall revert back to the Promoter.
  31. The law of South Africa governs these terms and conditions and participants are subject to the exclusive jurisdiction of the South African courts.
